Can Bankruptcy Stop Foreclosure

Many homeowners these days are going through the mortgage foreclosure process. Most of them usually end up filing for bankruptcy in an attempt to save their properties from being auctioned off. The bankruptcy option is actually the process least understood by a lot of homeowners. It is also the least popular at that. However, this option can actually provide a ray of hope for mortgage foreclosure victims. There maybe drawbacks in filing for it in one way or the other. But it may actually save your home and your credit history at the same time.



Bankruptcy is also referred to as Chapter 13. It a provision of the law where in a restructured payment plan is created in an attempt to mend ones debts and credit problems. The payment plan through bankruptcy can sometimes get very expensive. But a lot of individuals still go for it just so they can get their finances back on track. After all your obligations are met, the bankruptcy clause would be lifted and the repayment of regular mortgage continues.

If foreclosure is your main problem, you can actually file for bankruptcy and stop the entire mortgage foreclosure process - at least for a certain period of time. This is most applicable at the point wherein the trustees sale is being enforced. Usually, this is the most critical part of the entire process of bankruptcy, especially for those facing an imminent foreclosure on their mortgage. Filing for Chapter 13 will give the borrower some time to plan and hopefully, save their ownership of the property.

Chapter 13 can be a good option for people who are facing foreclosure. But of course, you may also want to exhaust all of your alternatives first. Bankruptcy is not always the best solution, but it is still a solution nonetheless. Every mortgage foreclosure situation is unique. What works for others may not work for you and vice versa. It takes a lot of financial analysis to find the best possible solution to your money concerns.

Ideally, mortgage foreclosure should be the last resort for many homeowners facing foreclosure. Talk to a lawyer who handles personal bankruptcy cases and try to acquire a good understanding of everything involved in this particular law. You have to be well-informed about the implications of bankruptcy before filing for it because it is going to affect your finances and social status more than anyone else.
Can Bankruptcy Stop Foreclosure
Bankruptcy is a legally declared inability or impairment of ability of an individual or organization to pay their creditors. Creditors may file a bankruptcy petition against a debtor ("involuntary bankruptcy") in an effort to recoup a portion of what they are owed. In the majority of cases, however, bankruptcy is initiated by the debtor (a "voluntary bankruptcy" that is filed by the bankrupt individual or organization).

Debt is a result of spending more than one's income in a given period. To reduce debt, the most obvious solution is to reduce monthly spending to allow extra cash flow to service debt. This can be done by creating a personal budget and analyzing expenses to find areas to reduce expenses.Most people, when reviewing a written list of their monthly expenses, can find ways to reduce expenses. Common areas for expense reduction would include reducing food expenses by eating out less often, taking public transportation instead of driving a car, and eliminating enhanced telephone and cable television services.Creditors understand that bankruptcy is an option for debtors with excessive debt, so most creditors are willing to negotiate a settlement so that they receive a portion of their money, instead of risking losing everything in a bankruptcy.

Negotiation is a viable alternative if the debtor has sufficient income, or has assets that can be liquidated so that the proceeds can be applied against the debt.

Negotiation may also buy the debtor some time to rebuild their finances.

The principal focus of modern insolvency legislation and business debt restructuring practices no longer rests on the liquidation and elimination of insolvent entities but on the remodeling of the financial and organizational structure of debtors experiencing financial distress so as to permit the rehabilitation and continuation of their business.Therefore bankruptcy should not be used to avoid foreclosure.

Debt Consolidation is a better mean to deal with foreclosure.A typical proposal would involve a debtor making monthly payments for a maximum of five years, with the funds distributed to their creditors. Even though most proposals call for payments of less than the full amount of the debt owing, in most cases, the creditors will accept the deal, because if they don't, the next alternative may be personal bankruptcy, where the creditors will get even less money. The creditors have 45 days to accept or reject the consumer proposal. Once the proposal is accepted the debtor makes the payments to the Proposal Administrator each month, and the creditors are prevented from taking any further legal or collection action. If the proposal is rejected, the debtor may have no alternative but to declare personal bankruptcy.
